We may use third-party services to provide features of the Service. You acknowledge that we shall not be responsible for any third-party services, including their accuracy, completeness, legality, or any other aspect thereof.

11. Availability and Updates

The Service is provided on an "as available" basis. We do not guarantee that the Service will always be fully available due to maintenance, technical issues, or updates.

We may from time to time provide updates, patches, bug fixes, or other modifications to the Service. You agree that:

  • All updates are subject to these Terms

12. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPPILOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:

  • Warranties that the Service will meet your requirements or achieve any intended results

No oral advice or written information given by CapPilot or its representatives creates any warranty.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPPILOT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Business interruption or personal injury
  • Any damages arising from your use of or inability to use the Service
  • Any investment losses or financial damages resulting from reliance on the Service

Our total liability for any claims arising under these Terms is limited to the amount you paid to us for the Service during the twelve (12) months prior to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold CapPilot and its affiliates, officers, employees, agents, and partners harmless from any claim or demand, including reasonable attorneys' fees, arising out of:

  • Your violation of any right of a third party
  • Any User Content you submit or store in the Service

15. Term and Termination

These Terms remain in effect as long as you use the Service or have an active subscription.

You may terminate at any time by stopping use of the Service and deleting your account. If you have an active subscription, termination will be effective at the end of the current subscription period.

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, you must cease all use of the Service.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes at least 30 days before they take effect by email or directly in the Service.

By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the changes, you must stop using the Service before the effective date.

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and CapPilot concerning the Service and supersede all prior agreements.
